Terms of Use

These terms govern your use of our website and services. By accessing our website or engaging with our services, you agree to be bound by these terms. Please read them carefully before proceeding.

About These Terms

This document establishes the legal relationship between you and persistent-guide when you use our website or purchase our services. We've written these terms to be as clear and straightforward as possible while covering necessary legal points.

Throughout these terms, "we," "us," and "our" refer to persistent-guide. "You" and "your" refer to anyone using our website or services. "Services" encompasses all consultations, workshops, coaching, membership benefits, and other offerings we provide.

If any provision of these terms is found to be unenforceable, the remaining provisions continue in full effect. Our failure to enforce any right or provision does not constitute a waiver of that right.

Acceptance of Terms

By accessing our website, you acknowledge that you have read, understood, and agree to be bound by these terms along with our Privacy Policy and Cookies Policy. If you disagree with any part of these terms, please do not use our website or services.

These terms apply to all visitors, browsers, and others who access or use our services. Additional terms and conditions may apply to specific services, which will be made clear when you book those services.

We reserve the right to modify these terms at any time. Changes become effective immediately upon posting to our website. Continued use after changes constitutes acceptance of the modified terms. We will notify active clients of significant changes via email.

Use of Our Website

Permitted Uses

You may browse our website, read content, contact us about services, and access resources we make available. You may print or download content for personal, non-commercial use, provided you maintain all copyright and other notices.

Prohibited Uses

You must not use our website in any way that causes damage to the website or impairs its availability or accessibility. You must not use it in any unlawful manner or in any way that is harmful or fraudulent.

Specific prohibited activities include attempting to gain unauthorized access to our systems, interfering with other users' enjoyment of the website, using automated systems to scrape content, transmitting malicious code or viruses, and using the website to send spam or unsolicited communications.

You must not copy, reproduce, redistribute, or republish website content beyond personal use without our written permission. This includes text, images, design elements, and other materials.

Service Bookings and Purchases

When you book a consultation, workshop, or other service, you are making an offer to purchase that service subject to these terms.

Booking Process

After you contact us about a service, we will provide available dates, confirm pricing, and arrange payment. A booking is confirmed when you receive written confirmation from us, typically via email. This confirmation constitutes acceptance of your offer and creates a binding contract.

Pricing

Prices are stated in British pounds and include VAT where applicable. We reserve the right to change prices at any time, but changes do not affect bookings already confirmed. The price you pay is the price stated at the time of booking confirmation.

Payment

Payment is typically required at the time of booking unless alternative arrangements are agreed in writing. We accept payment by bank transfer or major credit and debit cards. Payment must be received before the scheduled service date.

Cancellation and Refunds

You may cancel a booking more than seven days before the scheduled date for a full refund. Cancellations made between three and seven days before the scheduled date receive a fifty percent refund. Cancellations made less than three days before the scheduled date are non-refundable.

We reserve the right to cancel services due to circumstances beyond our control, such as instructor illness or insufficient enrollment. In such cases, we will offer alternative dates or provide a full refund.

Community membership subscriptions can be cancelled at any time, with cancellation taking effect at the end of the current billing period. No refunds are provided for partial months.

Rescheduling

You may request to reschedule a booking up to five days before the scheduled date without penalty. Rescheduling requests made less than five days before the scheduled date are subject to availability and may incur additional fees.

Service Delivery and Expectations

We strive to deliver high-quality services that help you discover and develop meaningful hobbies. However, outcomes depend significantly on individual engagement, circumstances, and factors beyond our control.

No Guarantees

While we have extensive experience and a strong track record, we cannot guarantee that you will find a hobby you enjoy or that any particular hobby will suit you. Hobby development is a personal journey with many variables.

Our role is to provide expert guidance, resources, and support. Your success depends on your willingness to explore, practice, and persist through initial challenges.

Your Responsibilities

You are responsible for providing accurate information during consultations, attending scheduled sessions punctually, following safety guidelines during workshops, and communicating any concerns or special requirements.

You should engage with recommended activities with reasonable effort and realistic expectations. Learning new skills takes time and practice.

Workshop Participation

Workshop participants must follow all safety instructions provided by instructors. We provide basic safety equipment and instruction, but you participate at your own risk. Inform us in advance of any health conditions, allergies, or limitations that might affect your safe participation.

Limitation of Liability

To the fullest extent permitted by law, persistent-guide shall not be liable for any indirect, consequential, or incidental damages arising from your use of our website or services.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

For all other types of loss, our total liability to you arising from or connected with these terms or our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, strikes, equipment failures, or power outages.

Third-Party Services and Links

We may recommend or facilitate connections with third-party service providers such as hobby instructors, suppliers, or community groups. These third parties are independent, and we do not control their services or practices.

Our website may contain links to third-party websites for your convenience. We do not endorse or take responsibility for the content, policies, or practices of third-party websites. Your interactions with third parties are at your own risk.

We make no warranties about third-party services and disclaim liability for any problems arising from your use of them, even if we recommended them.

User-Generated Content

If you submit content to us, such as testimonials, feedback, or photographs from events, you grant us a non-exclusive, worldwide, perpetual license to use, reproduce, modify, and display that content for promotional and operational purposes.

You represent that any content you submit is your own original work or that you have permission to share it, and that it does not violate any third party's rights or any laws.

We reserve the right to refuse, edit, or remove any submitted content at our discretion without notice or explanation.

Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our services, you also agree to the practices described in our Privacy Policy.

We handle personal data in accordance with the General Data Protection Regulation and UK data protection laws. You have various rights regarding your personal data, as explained in our GDPR information page.

Confidentiality

Information you share during consultations and coaching sessions is treated confidentially. We do not disclose personal details about clients without their consent, except where legally required.

However, confidentiality has limits. We may need to break confidentiality if we have serious concerns about risk of harm to you or others, or if legally obligated to disclose information to authorities.

Anonymized information may be used for research, training, or marketing purposes in a way that does not identify individuals.

Complaints and Disputes

If you are dissatisfied with any aspect of our services, please contact us at [email protected]. We take complaints seriously and will investigate promptly and fairly.

We will acknowledge your complaint within three business days and provide a full response within fourteen days. If we need more time to investigate thoroughly, we will keep you informed of progress.

If we cannot resolve a dispute informally, both parties agree to attempt mediation before pursuing other legal remedies. Mediation costs will be shared equally.

Governing Law and Jurisdiction

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in those jurisdictions, and nothing in these terms affects your statutory rights as a consumer.

Severability

If any provision of these terms is deemed unlawful, invalid, or unenforceable by a court, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Entire Agreement

These terms, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and persistent-guide regarding use of our website and services, superseding any prior agreements or understandings.

Waiver

No waiver by us of any term or condition shall be deemed a further or continuing waiver of that term or any other term. Our failure to assert any right or provision under these terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer your rights or obligations under these terms without our written consent. We may assign our rights and obligations to another entity, but this will not affect your rights or our obligations under these terms.
